What is probate and how does it work?

Probate is the legal process of transferring a deceased person’s estate, or all the assets they owned, to their heirs and beneficiaries. This process is important in ensuring that the deceased’s wishes and legal rights are respected. Probate is overseen by the court, and the court appoints someone to oversee the process and to make sure the estate is distributed according to the deceased’s will. In Virginia, the process begins with the executor filing the death certificate and the will with the court. The executor then has to notify any creditors of the deceased and pay off any debts. The executor then collects all the assets belonging to the deceased and takes an inventory of them. This inventory is then filed with the court. Next, the executor distributes the estate according to the will. The executor must also file all taxes associated with the estate with the appropriate government agencies. The executor may also have to provide a report to the court regarding how the estate was distributed. Finally, the executor must provide a closing statement to the court that outlines how the estate was handled, distributed, and settled. After the final statement has been accepted by the court, the estate is settled and probate is complete.
