How long does it take to probate a will?

The process of probating a will and distributing assets takes approximately 6-12 months, depending on the complexity of the estate. In California, probate proceedings can become complicated if there is no valid will or if the will is contested by family members or creditors. These added complexities can add months or even years to the probate process. In California, the process of probating a will begins with the appointment of an executor, also known as a personal representative. This executor is tasked with locating and managing the deceased’s assets, paying creditors and taxes, and distributing the remaining assets to the beneficiaries. The executor must then file the official paperwork with the court and follow the rules of probate law in California. Next, the executor must provide proper legal notice to all interested parties, including beneficiaries and creditors, of the probate proceedings which can take up to five months. Following the notice period, creditors must be given an opportunity to make claims against the estate and the executor must review and resolve these claims. Once this process is completed, the court will review the will and approve the executor’s actions. Finally, the executor must file a final report with the court detailing how the estate was distributed and the court will issue a final order closing the probate case. When the probate process is efficiently managed, it is possible to complete the process within 6-12 months.
