How is a workers' compensation claim reviewed?

In Florida, workers’ compensation claims are typically reviewed by the Division of Workers’ Compensation (DWC). The DWC is responsible for ensuring that the appropriate procedures and benefits are in place for workers who have suffered a workplace injury or illness. The review process begins when a worker files a workers’ compensation claim. The employer or their insurance carrier then has the chance to provide documents and evidence to the DWC. The DWC will also review any medical records and other relevant information to determine whether the worker is eligible for benefits. If the DWC finds that the worker is eligible, the employer or their insurance carrier must provide compensation and medical benefits to the injured worker. The worker may be required to attend a medical evaluation to ensure that the treatment received is appropriate and effective. The worker can also work with a claims adjuster to make sure that the appropriate benefits are received. The DWC may also conduct a hearing if the employer or their insurance carrier disagrees with the worker’s claim.
