What is the difference between wrongful termination and wrongful act termination?
Wrongful termination is when an employee is fired from a job for an illegal reason. This could be because of their race, religion, gender, or other protected status by law. This type of termination violates the employee’s rights and is considered a form of discrimination. Wrongful act termination, on the other hand, is when an employee is fired from a job because of something that they did. This could be for something that violates company policy, such as stealing, or for misconduct like sexual harassment. In this type of termination, the employer may be able to prove that the employee did something wrong, even if it was not illegal. In New York, wrongful termination is illegal and can result in repercussions for the employer. Wrongful act termination, however, is not illegal and can be a valid reason for termination. Employers must take into account the nature of the act when deciding whether to terminate an employee for a wrongful act or not. If the employer chooses to terminate an employee on these grounds, they must be able to provide evidence of the wrongful act that the employee has committed.
