What is the difference between wrongful termination and wrongful abstinence?

Wrongful termination is the unlawful termination of an employee by the employer. This usually occurs when the employer fails to comply with federal or state employment laws. In Arizona, an employee who has been wrongfully terminated may seek damages for breach of contract, breach of implied contract, wrongful discrimination, and/or retaliatory termination. Wrongful abstinence, on the other hand, occurs when a company fails to hire a qualified person for a position. This type of discrimination usually occurs when an employer is prejudiced against someone based on their race, nationality, sex, age, or other characteristics. In Arizona, an employee who believes they have been the victim of wrongful abstinence may file a claim with the Arizona Civil Rights Division of the Attorney General’s Office. The main difference between wrongful termination and wrongful abstinence is that wrongful termination involves termination of an existing employment relationship while wrongful abstinence involves failure to hire a qualified person. In either situation, an employee may be able to recover financial or other damages from the employer, depending on the situation and the applicable laws.
