What is the difference between wrongful termination and unfair dismissal?
Wrongful termination and unfair dismissal are two different terms which describe the wrongful dismissal of an employee from their job. Wrongful termination is when an employer has acted in an unlawful manner when firing an employee, while unfair dismissal is when an employer has acted in a manner which is not in the best interests of the employee. In the state of Maryland, employers are required to meet certain criteria in order to fire an employee legally. These include following the procedures outlined in the employee’s contract, ensuring the termination is for a valid reason, and providing proper notice. If an employer fails to meet these criteria, the termination could be considered wrongful and the employee may be able to seek damages in court. On the other hand, unfair dismissal is when an employer has acted in a way which is unfair to the employee. This could include firing without cause or not providing the employee with the options or opportunities that they were entitled to. In this case the employee might not be able to obtain damages in court, but may be able to seek reinstatement in their position or receive compensation from the employer. Overall, the main difference between wrongful termination and unfair dismissal is that wrongful termination can be legally actionable, while unfair dismissal can generally only be remedied through seeking reinstatement or compensation from the employer.
