What is a third-party claim?

A third-party claim is a type of legal action related to an accident in Washington State. This type of claim is filed by an injured party against a third party who is not directly involved in the accident but is liable for causing or contributing to the injury. For example, if a person was injured in a car accident caused by a faulty car part, that person may file a third-party claim against the manufacturer of the car part. The injured person would be seeking compensation from the manufacturer for their injuries and related damages. Third-party claims can become complicated and involve many parties, such as insurance companies, employers, and other responsible persons or companies. It’s important to ensure that all parties involved in a third-party claim are properly identified and that you or your lawyer pursue the claim correctly. The state of Washington follows the theory of contributory negligence. Under this theory, your third-party claim may be dismissed even if the other party was mostly to blame for the accident if you contributed to the accident in any way. For this reason, it’s important to have an experienced attorney on your side to help you fully understand and pursue a third-party claim.
