What is the discovery period in a personal injury case?

In a personal injury case in New Jersey, the discovery period is the time allowed by law for the parties involved to exchange information related to the dispute. The time period for discovery is determined by the judge and, in general, begins when the plaintiff (the individual injured) files the lawsuit and ends when the pretrial conference takes place. During this time, both the plaintiff and the defendant may gather evidence, provide answers to questions (interrogatories) or provide documents (discovery requests) in order to establish their case. In New Jersey, the discovery process can last up to six months, although it may be shorter or longer depending on the facts of the case. During the discovery period, the plaintiff and the defendant can use requests for documents, depositions and interrogatories. The responses to these requests must be provided within the specified time frame and can be used as evidence in court when the case is tried. In the end, the discovery period is a chance for the plaintiff and the defendant to get information to support their respective cases and to prepare for trial. It is an important step in the litigation process and is necessary for both sides to be able to make their arguments effectively.
