What is a workers’ compensation claim?

A workers’ compensation claim is a mechanism that allows an employee who has been injured on the job to receive financial compensation for their medical costs, lost wages, and any future disability-related expenses related to the injury. In the state of Washington, employers must adhere to the workers’ compensation laws in order to provide employees with the necessary financial protection if they’re injured. A workers’ compensation claim can be filed against the employer who, in turn, is required to pay the employee’s medical costs and a portion of their lost wages. An employee can also bring a claim against a manufacturer or product that caused the injury. In this case, the claim is referred to as a product liability claim. It’s important to note that the injured employee does not have to prove fault in order to qualify for a workers’ compensation claim. The only requirement is that the injury must have occurred while the employee was performing job duties. In order to file a claim, the employee needs to provide the employer with a written notice of the injury and complete a form from the Washington State Department of Labor and Industries (L&I). The employee must also provide the employer with information about the type of injury, when it occurred, and how it occurred. Once the form is completed, the employee needs to submit it to L&I, who will review and process the claim.
