What is a wrongful termination claim?

A wrongful termination claim is a legal claim arising from a situation in which an employer has terminated the employment of an employee in violation of the employee’s legal rights. In Washington, wrongful termination claims typically involve alleged violations of an employee’s rights under the state or federal Constitution, or the state or federal laws, related to employment. For instance, an employee may have a claim for wrongful termination if they were fired for refusing to do something that their employer asked them to do that was illegal or unethical. Similarly, if the employee was fired for discriminatory reasons, such as their race, gender, national origin, or religious beliefs, they may also have a claim for wrongful termination. In Washington, wrongful termination claims must be brought within three years of the date of the alleged wrongful termination. If the claim is brought after this time, the employee’s right to recover damages may be limited or barred completely.
