What are the differences between Admiralty Law and common law?
Admiralty Law, or Maritime Law, is a body of laws that govern shipping, navigation, and other matters related to the sea. Common law, on the other hand, is a set of laws developed over time based on precedent and custom. While the two may seem similar, there are several key differences. Admiralty Law is a federal law that is enforced uniformly across the United States. This means that if an action violates Admiralty Law in Kansas, it will also violate Admiralty Law in any other state. Common Law, on the other hand, is a state law and can vary from state to state. That means that while certain actions may be illegal in Kansas under common law, they might be allowed in another state. Admiralty Law is also based on international conventions and treaties. These regulations allow states to handle a variety of situations, such as maritime accidents and other incidents, according to a standard set of rules. Common Law, however, applies to only domestic matters. Admiralty Law also covers a wide variety of matters, such as maritime contracts, seamen’s rights, and the marine environment. Common Law, by comparison, primarily deals with disputes between private citizens and organizations. Finally, Admiralty Law is handled in specialized courts, known as Admiralty Courts, while Common Law is handled in state or local courts. This means that any action which violates Admiralty Law must be heard in an Admiralty Court, while any action that violates Common Law can be heard in any court.
