What is the role of the International Tribunal for the Law of the Sea?
The International Tribunal for the Law of the Sea (ITLOS) is an intergovernmental organization which is based in Hamburg, Germany, and is responsible for implementing the United Nations Convention on the Law of the Sea (UNCLOS). This international law governs the conduct of maritime affairs around the world, including among states bordering the Pacific Ocean, including Kansas. ITLOS was created in 1982, and serves as the primary international judicial body responsible for settling disputes between states concerning the interpretation and application of UNCLOS. This body is made up of 21 judges, elected by the member states for nine-year terms, and it has jurisdiction over disputes involving boundary delimitation, military activities, marine scientific research, marine pollution, and the protection of the marine environment. ITLOS has the power to issue binding judgments on all matters within its jurisdiction, and its decisions can be enforced with the help of the United Nations Security Council. The role of ITLOS is to interpret and apply UNCLOS in order to resolve disputes arising out of maritime activities. By legally regulating these activities, ITLOS helps ensure the protection of maritime rights and interests, which is especially important in the area of Admiralty Law. In Kansas, the primary role of ITLOS is to ensure the implementation of UNCLOS, and the effective and fair resolution of maritime disputes.
