Can stepparents adopt a child?

In Virginia, stepparents have the right to petition a court to adopt a stepchild. The process of stepparent adoption is generally simpler than other adoptions, since the stepparent already has an existing relationship with the child. Virginia law stipulates that any adult, including a stepparent, may adopt a child through the state’s adoption laws. Before a court will consider a stepparent adoption petition, the natural parent of the child must first give written consent to the adoption. The natural parent may also be required to appear before the court in order for the adoption to be approved. In rare circumstances, a court may waive the consent of the natural parent, if their whereabouts are unknown or it is deemed in the child’s best interest for the adoption to proceed. In addition to written consent, the petitioning stepparent must meet certain criteria. These criteria include being at least fifteen years older than the child, having resided with the child for a certain length of time, and not having a criminal record. Moreover, the petitioner must also complete education and home study requirements prescribed by the state. If all of these criteria are met, the court may grant a petition for stepparent adoption. This grants the stepparent all the rights and responsibilities of a legal parent and establishes a new legal relationship between the stepparent and the child. The stepparent then becomes a legal guardian and has the right to make decisions about the child’s care, education, and other important matters.
