What is an intercountry adoption?
An intercountry adoption is when a family from one country adopts a child from another country in accordance with the laws of the country where the adoption takes place. This is sometimes referred to as an international adoption. In Indiana, the adoption laws are governed by IC 31-19-7 which covers such issues as: who is eligible to adopt, what documents need to be provided, and the relationship between the adoptive parents and the child. Additionally, IC 31-19-8 outlines the rules and procedures for processing an intercountry adoption. To begin the process, potential adoptive parents must obtain a home study. This process involves interviews with social workers and the evaluation of the family’s financial and emotional stability. Additionally, the family must complete a series of education classes about adoption. Once the home study is approved, the family then applies to an adoption agency that works in the county where the child is being adopted from. The agency will be responsible for obtaining the necessary paperwork and facilitating the adoption process. Once the adoption is finalized, the adoptive family will obtain a new birth certificate for the child that lists the adoptive parents as the legal guardians. Intercountry adoption is a rewarding but complex process. It is important to have a clear understanding of the laws of both countries, as well as any other legal requirements, before beginning the process.
