What are the different types of alternative dispute resolution?

Alternative dispute resolution (ADR) is a way to resolve disputes without having to go to court. ADR can include arbitration, mediation, or even private judging. In the state of Florida, ADR is governed by the Florida Arbitration Code and the Florida Mediation Act. Arbitration is often used in contract disputes. An arbitrator hears arguments from both parties, examines evidence, and makes a binding decision that is enforceable in court. The decision is rarely appealed, as it is mutually agreed upon by both parties. Mediation is a less formal form of ADR in which a mediator helps to facilitate a conversation between the parties in dispute. With the help of the mediator, both parties discuss the issue and create a solution that is mutually beneficial. The mediator does not make a decision but instead helps the parties to come to an agreement. Private judging involves the appointment of a private judge to hear the dispute and issue a decision. Private judges have the same authority as traditional judges and their decisions are enforceable in court. Unlike arbitration, private judging allows for the possibility of appeal to a higher court. ADR can be a helpful tool in resolving civil disputes without having to drag the dispute through the court system. It may offer a better opportunity for both parties to come to a mutual resolution without expensive court costs and time consuming court proceedings.
