What rights do advertisers have?

In Texas, advertisers have certain rights that are protected by the law. These rights include the freedom to advertise their products and services in a truthful, non-deceptive manner. Advertisers also have the right to use their own words and descriptions, as long as those words and descriptions are not false or misleading. Additionally, advertisers have the right to access consumers’ personal information, as long as the consumers have provided their consent for such access. Advertisers are also protected from any claims of unfair competition or antitrust violations, and the Texas Deceptive Trade Practices Act expressly states that it does not prevent businesses from engaging in lawful and legitimate advertising activities. Furthermore, advertisers have the right to use their trademarks and copyrights on products and services, so long as those trademarks and copyrights are registered with the federal government. Finally, advertisers have the right to challenge any advertising that they believe violates their rights or contains false or misleading statements. If they are able to prove that their rights have been infringed upon, they may be entitled to monetary damages.
