What rules regulate advertising for tobacco products?

In North Carolina, the rules that regulate advertising for tobacco products are dictated by both federal and state laws. Under the Federal Cigarette Labeling and Advertising Act, any advertisements for cigarettes must display a health warning that is approved by the U.S. Food and Drug Administration. Federal law also requires all tobacco advertisements to contain a warning that states, “Smoking by Pregnant Women May Result in Fetal Injury, Premature Birth, and Low Birth Weight.” The North Carolina Clean Indoor Air Act also regulates the advertising of tobacco products, prohibiting tobacco advertising in “places where minors can view it.” The restrictions include all locations near schools, daycare centers, and playgrounds. It is also illegal to place any tobacco advertisements on television or radio stations that are broadcast in North Carolina. In addition, the State of North Carolina requires that all tobacco advertising include a statement that reads, “The Surgeon General Has Determined That Smoking Causes Lung Cancer.” It is also illegal to make any false or misleading claims in advertisements for cigarettes or other tobacco products. Finally, coupons that redeemable for tobacco products are prohibited in the state.
