What are the guidelines for identifying “unfair” or “deceptive” practices?
In Delaware, it is illegal to practice deceptive or unfair advertising. Under the law, all businesses must act with honesty and integrity when they are advertising their services or products. Deceptive or unfair practices occur when a business deliberately misrepresents or conceals material facts or gives incorrect information in order to entice customers. This includes false statements, statements that are unsubstantiated, misrepresenting the nature or quality of a product, or making false or misleading comparisons with other products. In addition, it is illegal to promise benefits without providing evidence to back it up. The Federal Trade Commission (FTC) has established guidelines for identifying deceptive and unfair practices. These guidelines are meant to protect consumers from false or misleading claims. If a business engages in any of the practices listed above, they could face fines, government action, or other penalties. In addition, businesses must include any additional costs, such as taxes, shipping and handling charges, and other expenses in their pricing. They must also clearly disclose any terms of sale, including refund policies and fees associated with any services. Advertising laws are enforced by the Delaware Department of Justice. If you feel that you have been a victim of deceptive or unfair advertising practices, you can contact the Department of Justice to make a complaint.
