What types of advertising are regulated by the Federal Trade Commission?
Advertising in Florida and other states is regulated by the Federal Trade Commission (FTC). The FTC has the authority to regulate any kind of commercial advertising, as long as it meets certain standards of truthfulness and accuracy. Examples of advertising which must comply with FTC regulations include product or service advertising, endorsements (e.g. celebrity endorsements), product recall announcements, invoicing, discounts and promotions, and warranties. All of these ads must be truthful and can not be misleading or deceptive. In addition, advertising directed at children must be truthful and non-deceptive. The FTC provides guidelines for advertisers who create ads aimed at children, such as not using deceptive or misleading language, including advertising that may be attractive to children, but which does not meet FTC guidelines. The FTC also has authority to regulate telemarketing, or phone calls that offer a product or service for sale. Telemarketers must abide by the FTC Telemarketing Sales Rule when making sales calls and must include certain information during the phone call. This includes letting the customer know the cost of goods and services before agreeing to buy, as well as the terms and conditions of the offer. In short, the Federal Trade Commission regulates all types of commercial advertising (product, service, endorsements, etc.), telemarketing, and advertising targeted at children in Florida and elsewhere. All of these advertisements must be truthful and not misleading or deceptive in any way.
