What are the laws governing farm labor?

In California, the laws governing farm labor are primarily focused on the safety of the workers. All employers of agricultural labor must follow state laws ensuring safe and humane working conditions for their employees. The California Division of Occupational Safety and Health (Cal/OSHA) establishes standards to ensure the health and safety of farm workers, including provisions that require employers to provide workers with protective equipment, guard against potential hazards, and provide workers with training in first-aid and safety. In addition, the California Labor Code and Wage Orders provide workers with certain rights and protections. Farm workers are entitled to the same minimum wage as all other workers in the state and overtime pay for working more than eight hours in one day or forty hours in one week. Employers must also provide workers with rest periods, meal breaks, and other working conditions specified in the Wage Orders. The state also has laws in place to protect farm workers from discrimination and harassment. Californian employers are prohibited from discriminating against or retaliating against employees because of their race, color, religion, gender, or national origin. California also requires agricultural employers to provide workers with workers’ compensation insurance to cover any injuries or illnesses that result from their work. Finally, California has laws that require employers to ensure a safe and healthy workplace for farm workers. The California Environmental Protection Agency (EPA) establishes standards for air and water quality, animal and plant life, and pest control to protect the well-being of employees. The California Department of Food and Agriculture also requires employers to oversee the safety of crops, livestock, and other agricultural products.
