What are the laws governing biotechnology and genetically modified foods?

In North Carolina, biotechnology and genetically modified foods are regulated by the North Carolina Department of Agriculture & Consumer Services (NCDA&CS). The NCDA&CS works to protect the public health, safety, and welfare through rules and regulations specified in the North Carolina Administrative Code. The North Carolina statute regulating biotechnology, Chapter 106 of the General Statutes, defines biotechnology as “the application of biotechnological procedures to the production, improvement, or manipulation of living organisms or substances derived from living organisms.” This statute also requires the NCDA&CS to create and enforce regulations that govern biotechnological practices. In North Carolina, genetically modified foods are also regulated by the NCDA&CS. The NCDA&CS has established labeling requirements for foods made with genetically modified ingredients, and foods labeled as “natural” must not contain any genetically modified ingredients. In addition, the NCDA&CS requires that all food producers and distributors register with the agency before offering food for sale in the state. The NCDA&CS also works with the United States Department of Agriculture to enforce the Federal Meat Inspection Act, the Poultry Products Inspection Act, and the Egg Products Inspection Act. These laws provide a framework for inspecting and regulating meat, poultry, and egg products, and they are designed to protect the public from consuming products that may be unsafe or unhealthy.
