What are the laws governing the use of biodegradable plastic in agriculture?
In Florida, biodegradable plastic can be used in agriculture with some restrictions. The laws governing the use of biodegradable plastic in agriculture are found in Chapter 578 of the Florida Statutes. The law states that biodegradable plastic must be marked with a label stating that it is “biodegradable” and that it must also be in compliance with the guidelines of the Biodegradable Products Institute (BPI). The BPI is a non-profit organization that sets standards for biodegradable plastics produced in the United States. Biodegradable plastics must be designed to break down naturally into water, carbon dioxide, and other compounds during the normal course of their use, and must degrade within a reasonable time frame. For items used in the agricultural industry, biodegradable plastics must also be resistant to weather and UV degradation. Furthermore, the use of biodegradable plastic is only allowed if it does not pose a risk to human health or the environment. The plastic must not contain any toxic substances and must not release toxic substances upon its degradation. Finally, biodegradable plastic must be disposed of correctly according to local laws and regulations. Agricultural operations must ensure that they are in compliance with the regulations in their region.
