What rights do aircraft owners have under Aircraft Law?

Under Delaware Aircraft Law, aircraft owners have certain rights that are to be respected. These rights are outlined in title 21 of the Delaware Code, and generally include the right to own, possess, operate, and sell aircraft; to register and deregister their aircraft; to make claims and appearances on their own behalf; and to obtain insurance and liability coverage. Additionally, owners have the right to control their aircraft in compliance with FAA regulations, including the ability to fly in certain areas, to restrict or modify aircraft use, and to store or transport their aircraft. Owners also have the right to hold state aircraft-related titles and registrations and to hold aircraft-related security interests. Aircraft owners may also be held responsible for damages or injuries that result from the negligent operation or maintenance of their aircraft, and they must comply with any applicable federal aviation regulations and FAA inspections. They are also required to ensure that their aircraft meets all applicable safety standards and to file any necessary tax returns. Finally, aircraft owners are provided with certain protections under Delaware Aircraft Law. This includes the right to sue for damages or injuries they suffered due to another party’s negligence, the right to a jury trial in certain cases, and the right to access records and documents related to their aircraft without fear of being sued.
