What is the legal framework for aircraft hijacking?
The legal framework for aircraft hijacking in Delaware is addressed in the state’s criminal code. According to Delaware Code Title 11, Section 5132(b), anyone who unlawfully seizes or exercises control of an aircraft within the boundaries of Delaware is guilty of the crime of aircraft piracy. If convicted, this offense is considered a Class A felony and is punishable by imprisonment for up to 30 years. Additionally, the Delaware code states that the suspect may also be liable for civil damages in a separate action. Under Delaware’s terroristic threatening statute, Title 11, Section 5121, anyone who threatens to commit violence against an aircraft while it is in flight or on the ground, in order to cause death, injury, or physical damage to the aircraft, can also be charged with a Class A felony. Any person who aids or abets the hijacker in the act of taking control of an aircraft, or happens to be on board the plane during the incident, can be charged with aiding and abetting aircraft piracy. The punishment for this offense is the same as what is prescribed for hijacking the aircraft (Class A felony). Furthermore, if the act of hijacking results in death, the suspect may face the charge of first-degree murder, and if convicted, the punishment for this offense is life in prison. In summary, aircraft hijacking in Delaware is a very serious offense that carries a hefty punishment. Anyone found guilty of this crime can expect to face a long prison sentence, as well as potential civil penalties.
