How do international treaties affect domestic Aircraft Law?
International treaties have a major impact on domestic aircraft law in Washington. The U.S. Constitution grants the federal government the power to create and enter into treaties with other countries. As a result, any treaty that is entered into between the U.S. and another foreign nation is binding on all states, including Washington state. When it comes to aircraft law, many international treaties have been ratified that set standards for aircraft safety, airspace rights, and air traffic control. For example, the Chicago Convention of 1944 established the International Civil Aviation Organization (ICAO) to create uniform standards for civil aviation safety. This treaty has been ratified by Washington and all other states of the U.S., so any standards put in place by the ICAO are binding on Washington state and other states of the U.S. Similarly, the International Air Services Transit Agreement (IASTA) of 1944 sets international standards for the use of airspace and air traffic control. This treaty, along with other air agreements ratified by the U.S., has also been accepted by Washington and applies to aircraft within the state’s airspace. Therefore, any international treaties related to aircraft law that have been ratified by the U.S. are binding on all states, including Washington. These treaties provide a framework for all states to abide by when it comes to domestic aircraft law.
