When can an alimony agreement be terminated?

In Virginia, an alimony agreement can be terminated for three main reasons. The first is if the recipient of the alimony begins living with a new romantic partner of the opposite sex for more than three months. The second is if the recipient of the alimony remarries. The third is if there is a substantial change in either party’s financial circumstances. When the recipient of the alimony begins living with a new romantic partner, they should inform the court that they are doing so, so that the court can make a decision on whether to terminate the alimony agreement. The same is true if there is a substantial change in either party’s financial circumstances. The court will assess the change and determine if termination is necessary or appropriate. In cases where the recipient of the alimony remarries, then the agreement will be automatically terminated. This is regardless of whether the recipient informs the court or not. It is the responsibility of the recipient to inform the court of the remarriage, however. It is important to note that the court may also determine that the alimony should be extended or modified even if one of the three main reasons for termination is present. Each case is unique, and the court will take into account the specific circumstances of the case before making a decision.
