What happens if the payor moves out of the country?
If the payor (the person making alimony payments) moves out of the country, the Oklahoma courts cannot enforce the alimony order if the payor is physically outside of the United States. It is the obligation of the receiving party to take specific steps to enforce the alimony order if the payor moves out of the country. That being said, typically the court will order the payor to either place a deposit with the court to cover the alimony payments, or the court may also enter a foreign judgment to enable the receiving party to enforce the alimony order at a later date if necessary. It is important to note that the receiving party must act promptly to enforce the alimony order outside of the United States. If this action is not taken quickly enough, the receiving party may forfeit the right to collect alimony payments. Additionally, there may be complications with collecting alimony from an international payor due to the differences in currency and the potential difficulty in enforcing the court order. If the receiving party is unable to collect alimony payments from an international payor, the court may grant additional remedies such as sanctions or contempt of court proceeding if the payor was found to be in violation of the order. Ultimately, it is important for both parties to abide by the alimony order in Oklahoma and to seek legal counsel if they believe the other party is not following the terms of the order.
