What happens if the payor moves out of the country?
In Virginia, individuals who are obligated to pay alimony must continue to make payments even if they move out of the country. According to Virginia law, the court can still enforce an alimony order as long as the payor retains property or assets in the state of Virginia. The court may also issue a foreign judgment if the payor moves to a foreign country, which makes the payor responsible for complying with the court’s alimony order in the country they have moved to. If the payor is out of the country and cannot make payments, the court may take legal action to recoup past-due payments and force the payor to comply with the court’s order. This might include freezing the payor’s bank accounts, seizing assets, or garnishing income. Additionally, the court may issue arrest warrants if the court suspects that the payor is out of the country to avoid making payments. If the payor is able to pay but refuses to comply with the alimony order, the court may issue a show cause order. This would require the payor to appear in court and explain why the payments have not been made. If the court determines that the payor has intentionally avoided payments, they could file criminal contempt charges against the payor. This would result in fines or even jail time.
