Is alimony awarded if the recipient moves to a different state?

The short answer is no, alimony in Virginia is not automatically transferable if the recipient moves to a different state. The law in Virginia states that alimony is only enforceable if the court rules so. Generally, if the recipient moves out of the state, the court will stop awarding alimony. The court may, however, apply for a separate order so that alimony is still valid. This is usually used if the receiving spouse has not found a job or remarried and their living situation has not improved. In some cases, if the recipient moves to a state with similar laws, the court in Virginia may be able to transfer the agreement across states. This usually happens when two states have an agreement called a “uniform alimony act.” This agreement is intended to make sure that the alimony order from one state is honored in another state in the same way. However, many states do not have such an agreement which makes it difficult for the court to transfer orders. Ultimately, if the recipient moves to a different state, it is up to the court to decide if alimony will be enforced in that different state. The court may decide to transfer the agreement, depending on the laws of each state, but there is no guarantee that alimony will be enforced.
