What is a motion to disqualify an arbitrator?
A motion to disqualify an arbitrator in the state of Virginia is a legal process by which the parties involved in an arbitration dispute may challenge the impartiality or qualifications of the arbitrator. This motion may be filed if either party believes that the arbitrator is biased towards them, or that the arbitrator lacks the qualifications necessary to properly judge the case. In order to file a motion to disqualify an arbitrator, the parties must provide evidence that the arbitrator’s decisions are likely to be biased, or that the arbitrator’s experience and qualifications are not sufficient to fairly resolve the dispute. This motion must be filed with the court or the arbitration organization overseeing the case.
