How often can I receive a bankruptcy discharge?
The frequency with which you can receive a bankruptcy discharge depends on the type of bankruptcy you are filing. In Massachusetts, if you file under Chapter 7 (liquidation), you may only get a discharge once every eight years. If you file under Chapter 13 (payback plan), you may receive a discharge every four years. Generally, if you have received a discharge through Chapter 7 and then file for Chapter 13 protection, then you can receive a discharge the following day. However, if four years have passed since you received your Chapter 13 discharge, and you want to file again under Chapter 13, then you will need to wait for another four years before you can receive a discharge. Once a discharge has been received, creditors cannot attempt to collect any debts that were discharged in the bankruptcy case. When a debt is discharged, it is completely erased, so the creditor can not pursue collection efforts. If you are considering filing for bankruptcy, it is important to remember that the frequency of discharges may affect whether your petition is granted and how long it will take to receive a discharge. If you have not received a discharge in the past few years, you may consider seeking credit counseling or other forms of debt relief before pursuing bankruptcy.
