What is the law relating to e-commerce?
The law relating to e-commerce in Virginia follows the same principles as traditional commerce. This means that Virginia consumers who participate in e-commerce must adhere to the same laws and regulations as those engaged in other forms of commerce. The Virginia Consumer Protection Act outlines the laws that protect consumers when engaging in e-commerce. These laws include prohibitions against misleading or deceptive advertising, unfair trade practices, and other abuses. The Virginia Consumer Protection Law requires that sellers of products or services disclose any known material risks associated with the product or service. Additionally, Virginia law requires that all merchants, both traditional and online, clearly disclose all terms and conditions of any sale. This includes the total cost of the product or service, delivery costs, any possible fee changes, and any other terms that the purchaser must agree to in order to complete the sale. Finally, federal laws, such as the Electronic Signatures in Global and National Commerce Act, protect the rights of consumers when engaging in e-commerce. This law provides the legal equivalent of a “wet signature” when using electronic forms of communication, including the internet, emails, fax machines, and telephones. This law also requires that merchants provide clear and understandable “click-through” agreements when engaging in e-commerce. By providing this protection to consumers, e-commerce in Virginia operates with the same protections as any other form of commerce.
