What is the process for registering a trademark?
Registering a trademark in Washington is a two-step process. The first step is to search the Washington Trademark Database (WTD) to make sure the trademark you want to register is not already in use. This can be done online. If the trademark is already in use, you will not be able to register it. The second step is to file a trademark application with the USPTO (United States Patent and Trademark Office). To do this, you need to fill out and submit a form to the USPTO. The USPTO will then review your application and may reject it if the trademark is too similar to an existing one. Once your application is approved, you will need to pay the required fees and submit a specimen of the trademark. A specimen is something that displays the trademark in a recognizable way such as a label, drawing, or photograph. After you have submitted the specimen, your trademark will be officially registered. You can also register a trademark in Washington with the Secretary of State. This is a simpler process than registering with the USPTO, but it is not as strong legally and does not offer the same protections as registering with the USPTO. In either case, it is important to make sure your trademark is unique and not already in use in order to protect your rights.
