What legal protections are available to children with disabilities?

In California, children with disabilities are provided with legal protections to ensure their right to live a full and meaningful life. The federal Individuals with Disabilities Education Act (IDEA) gives children with disabilities the right to receive services, accommodations and modifications in order to receive a free and appropriate public education. Additionally, California’s Statewide Education and Training Advisory Committee on Early Start (SETAC) works to ensure compliance with the federal law by providing resources to families. The Fair Housing and Employment Act (FEHA) also provides protection for disabled children in California. The law prohibits housing and employment discrimination based on disability, giving disabled children the right to receive reasonable accommodations in both areas. Additionally, California’s civil rights laws, including the Unruh Civil Rights Act and the Bane Civil Rights Act, afford disabled children the right to be free from discrimination based on disability in public places. The Americans with Disabilities Act (ADA) also provides disabled individuals with the right to access all public places with reasonable accommodations. Finally, California’s Children’s Bill of Rights serves as a powerful reminder of the rights all children have and provides legal protection for disabled children by requiring public schools to address their individual needs in a nondiscriminatory manner. These laws provide disabled children and their families with legal protections and the assurance that their rights will be respected. Armed with legal protection, disabled children have the tools they need to succeed and to live a full and meaningful life.
