Yes, there are laws governing the advertising of cannabis products in Washington. Cannabis advertising is regulated by the Washington State Liquor and Cannabis Board (WSLCB). All advertising must be truthful and not misleading, and it must be aimed at adults 21 and older. Cannabis advertising is prohibited from making any medical claims or urging consumption of the product. In other words, advertising must not be explicitly or implicitly aimed at minors or non-medical use. Advertising must also not target any racial or gender-specific groups and must not urge consumers to purchase more than is necessary for their personal use. Advertising must also not be placed in any medium (print, broadcast, or digital) where more than 30% of the audience is expected to be under the age of 21. All advertising must include a warning label, "This product has intoxicating effects and may be habit-forming" near the top in lettering that is at least half the size of the product name. Cannabis advertising must also comply with all other state, local, and federal laws, including Washington’s consumer protection laws. Violators of the WSLCB advertising rules may be subject to civil and/or criminal penalties.
