Are there any restrictions on the use of cannabis at work?

In Virginia, the use of cannabis is limited to adults 21 and older, and the use of cannabis is strictly regulated. In terms of cannabis use at work, there are restrictions in place. According to Virginia law, employers are not allowed to let or require their employees to use cannabis while on the job, either on their business premise or any other location. Employers are allowed to prohibit the possession and use of cannabis in the workplace and to require drug tests. Employees are also prohibited from consuming cannabis in the workplace and from performing job-related duties while under the influence of cannabis. In addition, employers are allowed to take disciplinary action for employees found to be in possession of, using, or under the influence of cannabis while on the job. Such disciplinary action could include but is not limited to disciplinary warnings, suspension without pay, or termination of employment. Additionally, employers cannot discriminate against an employee for testing positive on a test for cannabis, as long as the employee is legally allowed to possess it and is not using it in violation of a workplace policy.
