Can I appeal a sentence that is within the statutory range?

In Virginia, it is possible to appeal a sentence that is within the statutory range, however, it is not considered a straightforward process. When a person is sentenced within the statutory range, it means that the court found that the sentence fits within the guidelines set by the state for a particular type of crime. If a person believes that this sentence was unfair or incorrect, they may file an appeal with the appellate court. In order to appeal, the appellant must demonstrate that the sentence imposed was not in harmony with the clear language of the statute or that the evidence presented at the original trial did not support the sentence. The Virginia Supreme Court may find that the sentence was imposed in violation of the defendant’s statutory rights or as a result of some other error. If successful, the court will overturn the sentence and replace it with a new one in line with the state’s statutes. For some cases, however, a successful appeal is not guaranteed. The appellate court will decide whether the original sentence was fair and appropriate and the appellant may not be able to provide enough evidence to prove otherwise.
