What if the other driver does not have enough money to pay for my damages?
If the other driver does not have enough money to pay for your damages in a car accident in Massachusetts, you may be able to receive compensation from your own insurance carrier. Massachusetts is an at-fault state and requires that drivers carry a minimum of $20,000 in bodily injury liability and $5,000 in property damage liability insurance. If the other driver’s insurance does not fully cover your injuries and damages, you could possibly turn to your own insurance under what is called “uninsured or underinsured motorist protection,” also known as UM/UIM. UM/UIM coverage will cover your expenses in a car accident such as medical bills, lost wages, and pain and suffering if the at-fault driver does not have enough (or any) insurance of their own. This option is especially important to have if you have more than the minimum amount of liability insurance. You may also be able to file a lawsuit against the at-fault driver for the remaining amount of damages not covered by their insurance. In a lawsuit, you can make a claim for financial compensation for your injuries, property damage, and other losses. Before considering a lawsuit, it is important to understand the law and your rights when it comes to car accidents in Massachusetts.
