How is a settlement determined in a catastrophic injury case?

A settlement for a catastrophic injury is usually determined based on the type of injury and the harm that was caused as a result of the injury. Generally, a settlement is an amount of money that is paid to the victim and their family by the individual responsible and/or their insurance company. In Florida, a catastrophic injury will usually require the use of a “pain and suffering” formula to determine a settlement. This requires assigning a monetary value to the injury and then taking into consideration other factors such as the current medical costs, estimated future medical costs, lost wages, and other related expenses. The victim’s family may also be eligible to receive compensation for the loss of companionship or wrongful death. The amount of the settlement will depend on the individual circumstances and the severity of the injury. Other factors that are considered include the victim’s age, life expectancy, pre-injury medical condition, prognosis, and earning capacity. Furthermore, the court may consider the degree of negligence by the responsible party, the amount of insurance coverage, the conduct of both parties, and the cost of litigation. The court will also consider whether or not the individual responsible has the ability to pay the settlement amount. All of these considerations must be taken into account before a settlement amount is determined. After all the factors are considered, the court will make a final decision as to the amount of the settlement. If either party is unhappy with the decision, they can file an appeal with the appellate court.
