How do I request validation of a debt?

If you are in California and wish to request validation of a debt, then you must utilize the process established by the Consumer Debt Defense Law (CDDL). According to the CDDL, you must submit a formal written request for the debt to be validated. This request must be sent via certified mail to the creditor or debt collector. In your request, you must include your name, the amount you are disputing, the reason for your dispute, and any additional evidence or documentation of the debt. Once the creditor or debt collector has received your request, they are legally obligated to validate the debt within 30 days. To validate the debt, the creditor or debt collector must submit written proof that you are indeed the sole responsible party for the debt and that the amount correctly reflects the current balance on the debt. If they cannot provide this proof, then they are required to cease any collection activities and stop calling you. It is important to remember that simply submitting a debt validation request does not absolve you of any legal responsibility. If the debt is validated, then you still must take steps to settle the debt. If the debt is not validated and the collection activities cease, then you may still be legally responsible for the debt, although the debt collector will not be able to take any legal action against you.
