What kind of evidence is needed to win a collection defense law case?

In order for a plaintiff to prevail on a collection defense law claim in Maryland, they must be able to prove that the defendant acted in a manner that breached the terms of the contract between the parties. The plaintiff must present evidence that they suffered a quantifiable loss of money and/or property as a result of this breach. This evidence must be in the form of documentary evidence such as receipts, invoices, or bank statements to demonstrate that the defendant has failed to pay what was owed under the contract. The plaintiff must also prove that the breach of contract caused the damages or losses that they are seeking to recover. This can be done through testimony, specialists’ reports, and even photographs in some cases. The plaintiff must demonstrate that the defendant’s actions directly caused the losses, as opposed to an independent event which may have also contributed to their losses. Finally, the plaintiff must present evidence that the losses were foreseeable at the time of the contract. This can be done through documentary evidence, such as emails or letters, which show that both parties were aware of the risks associated with the contract at the time of its formation. Testimony from any experts, witnesses, or parties involved in the contract or claims process can also be extremely helpful in proving that their losses were foreseeable.
