What is the role of the courts in enforcing consumer fraud law?
The courts play a vital role in enforcing consumer fraud law in North Carolina. This is the case because laws exist to protect consumers from unfair and deceptive business practices. By enforcing consumer fraud law, the courts ensure consumers are not taken advantage of. When a consumer files a complaint alleging a business has committed a deceptive or unfair act, the court will first evaluate the complaint to determine if it meets the requirements of the law. If the complaint does not meet the requirements, the court may dismiss it. Once the court determines the complaint is legitimate, it will hear the evidence presented by both parties, including witness testimony and documents. After considering all evidence, the court may choose to issue an injunction or a judgment against the accused party. An injunction is a court order prohibiting a certain action or behavior while a judgment is a formal ruling made by the court. In addition to issuing injunctions and judgments, the court has the power to award damages to the consumer if the court finds the business acted wrongfully. Damages are a monetary award paid by the business to the consumer to make up for the losses suffered by the consumer due to the business’s wrongful conduct. The courts play a pivotal role in upholding consumer fraud law in North Carolina. By evaluating consumer complaints, hearing evidence, issuing injunctions and judgments, and awarding damages, courts help to ensure that consumers are protected from wrongdoers.
