What is the role of an expert witness in civil law?
An expert witness is an individual who has specialized knowledge relevant to a particular case in civil law, such as a doctor, an engineer, or an appraiser. In Pennsylvania, an expert witness can provide testimony and opinion in court proceedings. This testimony and opinion is usually used to help the court to understand scientific and technical evidence and to decide complex questions of fact. The role of an expert witness is to provide an impartial opinion based on his or her scientific, technical, or specialized knowledge of a particular subject, and to assist the court by sharing their expertise on relevant topics. In order to give an opinion, an expert witness must have adequate qualifications, such as experience, education, or training in the relevant field. The expert witness may not have a personal bias or interest in the outcome of the case. When giving the opinion, the expert witness must be able to explain the basis of their opinion and show that it is an objectively reasonable conclusion that is not simply based upon their personal belief. They must also be able to answer additional questions from the court or attorneys in the case. Ultimately, the role of the expert witness is to provide factual, impartial evidence to the court and to the parties involved in a civil case and to help the court interpret complex evidence. This testimony can be critical in helping the court arrive at a decision and influencing the outcome of a civil case.
