What is a temporary injunction in civil law?
In civil law, a temporary injunction is an order issued by a court to an individual or entity to stop an action or to carry out a certain course of action. This is typically done to prevent a potential harm before the court can decide on the matter. The injunction can also order a party to do something to preserve the status quo until the court can hear the matter fully. In Colorado, temporary injunctions are particularly common during civil litigation. Before the court can make a final ruling, the court may issue a temporary injunction to keep the parties from making any further changes that could alter the existing conditions. For example, if a person is suing for breach of contract, the court may issue a temporary injunction to stop the defendant from canceling the contract or making any changes that would affect the outcome of the lawsuit. The court decides when a temporary injunction is necessary and can limit the terms of the injunction so that it does not unfairly affect either party. Before the court issues a temporary injunction, the party requesting the injunction may have to post a bond to ensure that they will pay any losses that result from the injunction. The party against whom the temporary injunction is issued usually has the opportunity to contest the injunction in court. The court can also dissolve the temporary injunction later if it no longer serves its purpose or if the court determines that the injunction was wrongfully issued. Once the court decides on the matter, the temporary injunction is no longer in effect.
