What is the difference between class action and individual representation?
Class action law allows a group of people to sue a company or organization as one group, rather than individuals filing suits separately. This type of litigation is used when many people have a similar type of claim against the defendant and it is more cost effective to bring claim as a group. In contrast, individual representation occurs when one person brings a claim against an entity or person. This type of representation is suitable for complex cases that involve damages to one individual only, or for cases that involve a single defendant. In Hawaii, the Class Action Law allows claims to be brought by one group representative who acts on behalf of the other members of the group, and the individual members can opt out of the class action suit. The class action law is used to protect consumers’ rights, and to ensure that businesses do not take advantage of them. Class Action Law and individual representation have different benefits, advantages, and drawbacks, depending on the type of case and its complexity. Class action law can help a large group of people seek justice and settlement when they would not be able to do so otherwise. On the other hand, individual representation is more suitable for cases that are complex and involve damages to one person only.
