What are the consumer rights regarding the advertising of prescription drugs?
In Washington, consumers have a right to clear, accurate, and truthful information about prescription drugs advertised to them. This includes all forms of advertisement, such as printed materials, radio or television commercials, or advertisements on the internet. Prescription drug advertisements must clearly state that the product is a prescription drug and must include any risks or side effects associated with taking the drug. The advertisement must also include information about the conditions for which the drug is indicated. If a drug has no FDA (Food and Drug Administration) approvals, that must also be disclosed in the advertisement. Furthermore, any promotional material must not contain false or misleading claims, nor can it omit relevant information that could make the advertisement deceptive. A consumer also has the right to expect that the manufacturer can back up any claims made in the advertisement, so that they can make informed decisions.
