What is the difference between breach of contract and a tort?

Breach of contract and a tort are two distinct legal concepts in Oklahoma. A breach of contract occurs when one party fails to fulfill his or her obligations under an agreement between the two parties. This could mean not performing the terms of the contract, delivering faulty or sub-standard goods, or not paying on time. A tort, on the other hand, is a wrongful act or an infringement of a right that leads to civil legal liability. This could include causing physical harm, damage to property, invasion of privacy, or any other negligent or intentional behavior that results in harm to another person. The major difference between breach of contract and a tort is that breach of contract is between two parties in an agreement, while a tort is any wrongful act that may or may not be related to a contract. For example, if a company failed to deliver goods as promised in a contract, they would be in breach of contract. However, if a company caused harm to someone through negligence or intentional action outside of a contract, they would be liable for a tort. In Oklahoma, both breach of contract and tort claims can be taken to court, with the plaintiff seeking monetary damages for their loss. In civil court, the plaintiff must prove that the defendant was responsible for the breach of contract or the tort. Courts will consider evidence such as witnesses, documents, and other facts to determine if the defendant is liable.
