What is the TEACH Act?

The TEACH Act is a federal law that protects copyrighted material from being used in educational settings without permission. The acronym stands for the Technology, Education and Copyright Harmonization Act, which was passed in 2002. The TEACH Act allows educators to use copyrighted material for instruction in an online environment, provided the use meets certain requirements. In Nebraska, the TEACH Act recognizes that teachers and students can benefit from digital works such as images, videos, and audio recordings that are otherwise protected by copyright law. It permits the use of those materials for online teaching, provided that it is for a nonprofit, educational institution and meets various criteria, such as the material must be used as part of a mediated instructional activity. Under the TEACH Act, teachers and students can also show or perform works protected by copyright laws as part of an online class. The TEACH Act also requires that the online class is limited to students enrolled in the class, is not open to the public, and that the class is supervised by the educator. Prior to the TEACH Act, teachers and students had limited access to protected works. However, with the passage of this federal law, teachers and students now have much more flexibility to use those materials for educational purposes.
