What is a motion to modify child support?

A motion to modify child support is a legal process in which a party involved in a child support case can ask for changes to be made to the existing child support agreement. In Michigan, either parent can file a motion to modify child support, or a third-party, such as a grandparent or other custodial parent, can also file a motion to modify if they are being affected by the child support orders. When filing a motion to modify child support, the requesting party must have a valid legal reason for why they believe the modification is necessary. A valid reason could be a change in the income of either parent, a change in the custodial arrangement of the child, or a change in the child’s needs or expenses. Once a motion to modify child support is filed, a hearing date will be scheduled where both parties can present their case for or against the modification. The judge will then review all the evidence and render a decision to either grant or deny the motion. If the motion to modify is granted, the judge can issue a new court order that changes the existing child support agreement and orders. If either parent disagrees with the judge’s decision, they can file an appeal to have the decision reviewed by a higher court. It is important to contact an attorney to ensure that the motion is properly filed and properly argued in court, as the outcome of a motion to modify can have a long-lasting impact on the lives of both the parents and the child.
