A garnishment order for child support is a legal document that is issued by the court and enforced by the Virginia Division of Child Support Enforcement (DCSE). This document orders a noncustodial parent to pay child support directly to DCSE. When a garnishment order is issued, the noncustodial parent’s wages, salary, or other income will be withheld from their paycheck and sent to DCSE, who will then use the money to pay the child support. Anytime a garnishment order is issued, it is accompanied by a copy of the court order, which states the amount of child support that must be paid. This document will also include the date when the garnishment order was issued, as well as other important information, such as the employer’s name and address. In addition, the garnishment order will include a “notice of garnishment” which informs the noncustodial parent of the requirement to pay the child support. It states the amount of child support, when the garnishment order was issued, and the name and address of the employer who is to withhold the income. If a noncustodial parent fails to comply with the garnishment order, the DCSE may take legal action or garnishment orders can be enforced through the use of collection agencies.
